Trust Decanting

The Uniform Trust Decanting Act, effective January 1, 2019, changes the California Probate Code to allow fiduciaries to "decant" irrevocable trusts, that is, to modify the terms of an irrevocable trust without the consent of the beneficiaries or approval of the court, subject to certain exceptions. The new law presents more options. Trusts and estates attorneys alike should be familiar with the new law to better serve their clients. This program will walk you through it.
